Breakfast Meeting: Form 990: A Powerful Tool

For many organizations, the Form 990 is one of the most powerful communication tools they have with donors and other constituents. While the Form 990 is a tax form and is required to be filed to maintain tax exempt status, it goes well beyond the numbers and includes a significant amount of information about the governance and operations of the exempt organization. Do you know what donors and other users are seeing when they are looking at your organization’s Form 990? If you are a donor, do you know what parts of the return can provide information on some of the key information you might want to know about the organization? What parts of the return do the IRS and other watchdog organizations focus on? We will share with you helpful hints on what areas of the Form 990 are most important to focus on and best practices for evaluating the information provided.

About the Presenter: Kim Hunwardsen, Tax Partner, Eide Bailly & Deb Nelson, Tax Senior Manager, Eide Bailly

Tax Partner Kim Hunwardsen leads Eide Bailly’s Exempt Organization Tax Practice. During her 23 years serving nonprofit and health care organizations, Kim has developed an extensive understanding of the issues affecting tax-exempt organizations. Kim provides tax consulting, planning and compliance services to a variety of organizations. Kim speaks regularly to nonprofit and health care groups throughout the country on issues related to their tax-exempt status. In addition, Kim is part of Eide Bailly’s National Tax Office.

Tax Senior Manager Deb Nelson works exclusively with tax-exempt organizations and has more than 12 years of experience. Deb works with private foundations and nonprofits throughout the country on the preparation of Form 990-PF and Form 990, along with various tax consulting projects. Deb is part of Eide Bailly’s Nonprofit Editorial Board and has led Firmwide training sessions on issues of significance related to tax-exempt organizations. Deb regularly speaks to boards and committees on what they need to know about the Form 990 and how best to highlight the good work they are doing.

Education Program: Charitable Giving in Uncertain Times

With building momentum for tax reform sometime in the next 18 months, will there be a change in donors’ appetite for charitable giving? What are the risks? What are the opportunities? How can planners and planned giving professionals adapt to this new environment, both for current gifts as well as planned giving? Given many clients’ current attitudes about wealth – and, more specifically, the transfer of wealth to their children and grandchildren – this conversation may not be as challenging as it might seem on the surface. This presentation will explore all of these issues and more.

During this session you will learn:

  1. What income and estate tax proposals are currently being considered?
  2. What arguments can be made to keep charitable giving relevant if the tax benefits of giving become less of a selling point?

About the Presenter: Michael P. Sampson, Maslon LLP

Michael's legal practice focuses on high-end estate and tax planning, estate and trust administration, charitable planning, and business succession planning. Michael helps his clients focus on what it is they really want to accomplish with their wealth. After assisting his clients in identifying their specific wealth planning goals, Michael works with them and their other professional advisors to develop and implement wealth transfer strategies that are consistent not only with their goals, but also with their cash flow needs and tolerance for risk.

It is this practical focus on the real-life impact of wealth transfer planning that distinguishes Michael's approach from that of the typical estate planning attorney. Beyond preparing legal documents, he also serves as his clients' wealth coach, personal CFO, professional pest, and skeptic-for-hire. Michael also provides his clients with access to his deep network of contacts, which often leads to solutions for many of life’s little problems, even if they’re completely unrelated to what you would normally think of as "estate planning."

Michael is a frequent speaker at continuing legal education seminars and has served as an adjunct professor at Mitchell Hamline School of Law in St. Paul. He is also very active in the Minnesota State Bar Association, currently serving as a member of the Probate and Trust Law Section Council and as co-chair of the Section's Legislation Committee.

Michael currently serves as chairman of the Board of Directors of Guild Incorporated, a St. Paul-based non-profit that works with individuals with severe mental illness. Before joining the board of Guild Incorporated, Michael was a founding member and past chair of the Board of Directors of the Twin Cities German Immersion School (TCGIS).

Michael's hobbies include playing acoustic guitar, reading, photography, and listening to music. He attended Carleton College, where he majored in German. He attended law school at the University of Iowa. He is married and has two daughters.
